1. Operator and contract
MelodyQR is the service’s commercial name; its main website is melodyqr.com. The operator’s identification, address and tax details are available in Account settings after you sign in. Contact: support@melodyqr.com; Customer Service, Monday to Friday, 09:00–17:00 Argentina time, excluding local public holidays.
These terms cover free and paid software use. The accepted offer and refund policy complete the commercial conditions. Specifically agreed conditions prevail within their scope, without reducing mandatory rights or commitments in applicable offers and advertising. Privacy explains data processing; acceptance of these terms does not replace a specific consent required by law. A purchase from Paddle, when available, is a separate contract.
2. Accounts and authority
You must be at least 18 and legally capable of contracting. When acting for an organization, you must have authority to represent it. Terms and the offer will be available before acceptance. An express action identifies the accepted version and allows you to keep a copy. Free use also requires acceptance before managing resources. Visiting the website or scanning a QR does not contract the software or authorize a charge.
Keep account and billing information accurate, protect access and report unauthorized access. Administer members, roles and credentials within your authority. Workspace membership does not grant billing authority. Human users, API credentials and service accounts can only perform authorized actions within their plan and scopes. These duties do not remove MelodyQR’s own security obligations.
3. Service and QR codes
MelodyQR creates and manages SmartLinks: public links whose destinations can change without replacing the QR that contains their address. Depending on the accepted plan and available features, you can manage destinations, rules, menus, contact cards, landing pages, files, QR designs, analytics and integrations. You purchase software access, not ownership of an internet domain or MelodyQR public address. Future or experimental features are not included unless expressly offered.
A SmartLink QR depends on MelodyQR resolving its address, even after downloading or printing. Test design and destination before mass printing: readability also depends on size, contrast, printing, environment and device. Scan statistics measure observed requests and events, not unique people, sales or approved payments. External destinations also depend on their operators and your configuration.
4. Plans, prices and renewal
Paid plans apply per workspace, monthly unless the accepted offer specifies otherwise. Before payment, the plan, features, limits, currency, total, taxes, period and renewal are disclosed. Auto-renewal requires a separate authorization and continues until cancelled. Free use does not itself create charges. Keep the purchase confirmation and accepted offer.
Active and inactive SmartLink capacity are separate. Storage and features follow the accepted limits. Reaching a limit does not authorize surprise charges or deleting resources to fit a plan. Additional paid capacity requires a disclosed price and acceptance. Changes between paid plans are scheduled for the next period, subject to confirmation and capacity review; immediate prorated changes are only available if explicitly offered. Any future trial must disclose its duration and conversion to payment.
Base plan price increases will be announced at least 30 calendar days ahead, apply to a renewal after that notice and allow cancellation beforehand. An already paid period is not repriced. Currency conversion quotes and taxes are disclosed separately and follow the rules for each charge. Material reductions in paid features require advance notice and respect rights to performance, termination or applicable refunds; additional consent is obtained where required by law.
5. Seller and payment provider
For MelodyQR purchases through Mercado Pago, the operator contracts with you and Mercado Pago processes payment under its applicable conditions. The checkout and receipt identify the purchase channel. Commerce payments to a merchant are a different operation from that merchant’s MelodyQR subscription.
Paddle is planned and is not yet available for purchasing MelodyQR. Only when that channel is enabled, Paddle will act as authorized reseller and Merchant of Record through the entity identified in the transaction. Its Buyer Terms and Refund Policy govern that purchase; MelodyQR provides and supports the software. These service terms do not replace Paddle’s contract or reduce mandatory rights.
6. Cancellation
Cancel future renewals through Billing or request assistance from customer service. Ordinary cancellation ends future renewals and retains paid access until the paid period ends. We will communicate the effective date and confirmation. Cancellation is separate from a refund, deleting resources or closing an account. Applicable rights to termination with different effects remain available.
We do not require a renewal, a cancellation penalty or acceptance of new terms to process your request. For a future Paddle purchase, its confirmation email and paddle.net will also provide assistance. Mandatory public cancellation and withdrawal procedures and confirmations must be completed before these draft terms take effect; an email link alone does not replace them.
7. Refunds and withdrawal
MelodyQR offers a full refund of the first subscription payment if requested within 14 calendar days after that payment, including when the service was used. This additional guarantee does not restart with each monthly renewal. It does not reduce statutory withdrawal rights, remedies for defects, non-performance, incorrect charges or refunds owed by the seller.
For qualifying distance purchases by Argentine consumers, the law provides a ten-calendar-day withdrawal period, calculated under the applicable rules, and electronic notice is possible. Exceptions must be assessed under the applicable law; using the software is not a blanket contractual waiver. Other countries’ mandatory periods and remedies remain applicable.
Use the refund policy’s channels and identify the purchase without sending full card details, passwords or security codes. Repayment uses the original method where possible or an agreed lawful alternative. We distinguish processing from additional bank times and respect statutory deadlines. Paddle refunds terminate access to the refunded product; their effects on workspace access and publications must be defined before enabling that seller. A payment dispute is not itself fraud or a waiver; any temporary restriction must be justified and proportionate.
8. Expiry and printed links
Editing a SmartLink’s destination preserves its public identity. Previously assigned public identifiers are never silently reassigned to another user, including after deletion. Inactivation stops redirection and is reversible within your permissions and capacity, without a general 60-day recovery deadline. Permanent deletion is different and irreversible: the QR stops redirecting and shows a deleted state. Reserving an identifier does not keep its contents forever.
In the current Mercado Pago renewal flow, after paid access expires and seven grace days pass, editing becomes read-only and already published redirects and files are retained. There is no automatic conversion to Free or deletion solely for that expiry. Paddle expiry rules must be defined before enabling it. Ordinary continuity is not a promise of perpetual availability and does not cover requested deletion, account closure, abuse blocking, refunds, legal orders or service termination.
9. Your content
You retain rights to uploaded text, images, logos and files. You grant only the non-exclusive technical permission needed to host, process, reproduce and show content to provide the service and carry out your requested publications. This does not transfer ownership or authorize MelodyQR advertising. You must hold the necessary rights and lawful permissions for third-party personal data. Once no longer needed, the permission ends except for lawful residual storage described in privacy.
Published pages and files may be accessed, copied or shared by anyone with their address. An unguessable URL is not access control, and hiding a field does not remove it from a downloadable contact card or file. Do not publish confidential information. Publication does not authorize disclosure of private workspace resources or credentials; access to them is limited to service, security, support and legal needs.
10. Acceptable use
Do not use MelodyQR for illegal activities, fraud, phishing, impersonation, malware, unauthorized access, rights infringement or personal-data publication without a lawful basis. Do not bypass permissions or quotas or deliberately impair security and availability. Report abuse to customer service with the public URL and explanation, without unnecessary sensitive attachments.
Justified restrictions must be proportionate to risk and respect legal duties. Where safe and possible, we will explain the reason and allow correction or review. We do not promise pre-screening of all content or automatic detection of every threat. Measures do not erase rights to complain or obtain applicable refunds.
11. Merchant payments
Connecting a merchant’s own Mercado Pago account or payment link facilitates transactions between that merchant and its customers, separately from the MelodyQR subscription. The merchant is responsible for its offer, delivery, invoices, customer service and refunds. Mercado Pago processes those payments under its conditions. MelodyQR is not the seller of those goods or services and does not collect funds to distribute to merchants. Paddle does not process those sales through the subscription.
A scan or opened link does not confirm payment. Confirmation requires sufficient verification from the provider. Compatibility with every country, account or payment method is not guaranteed.
12. Software and third parties
Software, brand and MelodyQR materials remain the property of their rights holders. You receive service access under your plan and these terms. Third-party and open-source licenses remain applicable; this clause does not remove rights granted by law or those licenses. External services have their own conditions. You need authority to connect an account; MelodyQR’s own integration and data duties remain enforceable.
13. Support and responsibility
Customer service is provided through the listed channel and hours. No guaranteed response time or service-level agreement is offered unless specifically agreed or legally required. Mandatory acknowledgements and request-processing deadlines remain applicable. We take reasonable measures to address incidents and communicate material interruptions when possible. Maintenance, printing conditions and third-party outages may affect use; uninterrupted operation or particular commercial results are not guaranteed.
These statements do not exclude liability for MelodyQR’s breaches or mandatory legal remedies. Liability is not excluded or limited for intent, gross negligence or other cases where prohibited by law. This draft sets no monetary liability cap and requires review before entering into force.
14. Account closure and data
Request account closure or exercise personal-data rights through customer service. For shared workspaces, authority and effects on other members must be determined. Cancelling a subscription does not automatically close the account or delete data. Closure, export options, consequences for public resources and deletion schedules for each data type and backup must be completed before these draft terms take effect. No instant deletion or universal retention period is promised.
The privacy policy distinguishes data needed for service from legal, accounting and security retention. Published content may remain in third-party copies. Any processing agreements must describe the actual roles and operations, rather than assume all use is covered by contractual acceptance.
15. Termination, changes and disputes
Serious breach, illegal activity or justified risk may lead to termination, with notice and reasonable opportunity to remedy where safe and possible. Urgent measures may precede notice when security or law requires it; review remains available. Termination does not remove claims or applicable refunds and does not authorize future charges for periods not served. If MelodyQR discontinues service, we will give reasonable notice, explain available information-recovery options and address paid periods not provided under applicable law.
Material term changes will identify their version and effective date, with new acceptance where required and a way to cancel before they apply. No retroactive changes to existing charges or claims. Previous versions remain available; purely editorial corrections need not require another acceptance. Silence does not authorize new charges or data uses requiring consent. These terms follow Argentine law, preserving mandatory protections in the consumer’s jurisdiction and the legally competent authorities and courts. Paddle purchase disputes follow its separate contract and mandatory law. Invalid provisions do not waive non-waivable rights.
